MOBILE NOTARY SERVICES
TERMS & CONDITIONS

1. Separate Service
Mobile Notary Services are separate from HCCA’s accounting, bookkeeping, business support, and consulting services. These Terms & Conditions apply specifically to mobile notary appointments.
2. Scope of Services
HCCA provides mobile notarial services for documents and transactions eligible for notarization under applicable Texas law. The notary may perform only notarial acts authorized by Texas law and within the scope of the notary’s commission.
3. Notarial Fees
Notarial fees are charged separately from travel or other service charges. Fees are based on the applicable Texas fee limits and the notarial acts actually performed. Texas law permits a notary to charge less than the statutory maximum or no fee.
4. Travel Fee
Because this is a mobile service, a separate travel fee applies. The travel fee is based on the appointment location and appointment type and is separate from statutory notarial fees. The applicable travel fee will be disclosed and confirmed before the appointment is scheduled.
5. Wait Time
The first 10 minutes of waiting time are included. Additional waiting time may be charged in 5-minute increments, subject to the published maximum. If the appointment cannot be completed after the maximum waiting period, the notary may leave and the appointment will be considered incomplete.
6. Appointment Readiness
All required signers must be present and ready at the scheduled appointment time. Signers must have acceptable identification when required by law. Documents should be complete and ready for notarization before the notary arrives, except for signatures or other actions that must occur in the notary’s presence.
7. Identification & Personal Appearance
A signer must personally appear before the notary when required by Texas law. The notary will determine whether identification and personal-appearance requirements have been satisfied. If legal requirements are not met, the notary may be unable to perform the notarization.
8. Documents & Certificates
The customer is responsible for providing the correct document and, when applicable, the appropriate notarial certificate or wording. A Texas notary may not select the type of notarial certificate needed unless legally authorized to do so. The notary does not draft, prepare, or explain legal documents.
9. No Legal Advice
A notary does not provide legal advice, determine whether a document is legally sufficient, explain the legal effect of a document, or advise a customer which document or certificate should be used. Customers needing legal advice should consult a qualified attorney.
10. Refusal or Inability to Notarize
HCCA or the notary may decline or discontinue a notarization when required or permitted by law, including when required personal appearance, identification, willingness, competency, document, or other legal requirements are not satisfied.
11. Customer Responsibility
The customer is responsible for accurate appointment information, required signers and witnesses, required identification, and having documents ready. The customer is responsible for determining whether witnesses are required and arranging them unless otherwise agreed.
12. Witnesses
HCCA does not automatically provide witnesses. If witnesses are required, the customer must arrange them unless a separate arrangement has been confirmed in advance.
13. Scheduling & Confirmation
An appointment is not confirmed until the appointment details, applicable fees, and location have been accepted by the customer and confirmed by HCCA. Requested times are subject to availability.
14. Cancellations & Changes
Customers should provide as much notice as possible when canceling or changing an appointment. A new appointment may require a new travel fee. If the notary has already begun traveling, the applicable travel fee may remain due under the published cancellation policy.
15. Appointment Delays
Customers should notify HCCA as soon as possible if they expect to be delayed. Delays may result in waiting-time charges or require rescheduling.
16. Travel & Service Area
Mobile appointments are subject to HCCA’s service area, availability, travel conditions, and schedule. HCCA may decline appointments outside its normal service area or that cannot reasonably be accommodated.
17. Safety
The safety of the notary is a priority. HCCA may refuse, postpone, or leave an appointment location when conditions are unsafe, threatening, unlawful, hazardous, or otherwise unsuitable.
18. Payment
Applicable fees are due according to the payment terms provided when the appointment is scheduled. Notarial fees and travel fees may be listed separately. Customers are responsible for approved charges associated with the appointment.
19. No Guarantee of Notarization
Scheduling an appointment does not guarantee that a document will ultimately be notarized. The notary must comply with Texas law and may be unable to complete the notarization if legal requirements are not satisfied.
20. Privacy & Confidentiality
HCCA will handle customer information and documents with reasonable care and use information for scheduling, performing the requested service, administering payment, maintaining required notarial records, and complying with applicable law.
21. Notarial Records
Texas notaries are required to maintain a notary record book and comply with applicable recordkeeping requirements. Information required by law may therefore be recorded or retained as part of the notarial act.
22. Texas Law & Regulations
HCCA’s mobile notary services are performed in accordance with applicable Texas laws, rules, and regulations governing notarial acts. Texas notaries have statewide jurisdiction, subject to the requirements and limitations established by Texas law.
23. Updates
HCCA may update these Mobile Notary Terms & Conditions from time to time. The terms applicable to an appointment will be those provided or accepted in connection with that appointment.
24. Customer Acknowledgment
By scheduling or booking a mobile notary appointment with HCCA, the customer acknowledges that they have read, understand, and agree to these Terms & Conditions, including applicable notarial fees, travel fees, waiting-time charges, appointment requirements, and limitations of notarial services.
